You're right Bugs, can't blame the weapon only the shooter. Still night hunting seems like a bad idea.

This is sad, my question is what, why and where was the warden walking around at nite without a lite where some one is yote hunting, must have some big yotes there to shoot so high, either way the shooter is surely wrong it's like someone shooting into the bushes because they moved this is all very wrong?

It doesn't go into any detail about how they were hunting, but if they were using a predator call and just shooting at eyes they were being very careless in my opinion.
I have hunted predators (fox usually) at night, and I always used a shotgun and carried a bright spotlight to shine the critter with just before shooting. You can call and use a red light to reflect the eyes of responding critters, but the bright spotlight for positive identification is the only safe way I know to be sure you are shooting the intended prey. Other critters will answer a call, and it would be bad enough to shoot someone's dog, or a protected species.
I know here in Ohio the eyes you see at night could be a variety of critters - fox, coyote, raccoon, dog, cat (both feral and protected bobcat), opossum, deer, etc.
You better identify your target positively before you pull the trigger if you want to stay out of trouble!
